  Thank you for choosing “Pochipop” (“Pochipop”, "Service", "we", "us", "our", "Tech 4 billion Media Private Limited").  We are pleased to make our Service available to you.  Pochipop includes the Pochipop application, website, features and other associated services.  Pochipop provides image posting, video posting, and other services to users.  Pochipop includes social and interactive features.  This is our Privacy Policy, which helps explain our information practices.

 

  If you install, use, access Pochipop or any of its functions, you have read and accepted the terms of this Policy.  You have also accepted Pochipop's "Terms and Conditions and Content Policy", the "Community Guidelines" and other terms that are available on the Pochipop application, the Pochipop website, and others.  Be sure to read these documents.  By using Pochipop, you are entering into a binding contract or contracts with Pochipopi.  Your contract with us includes this Policy, the Terms and Conditions, the Content Policy, etc.  If you do not agree and do not accept the above, do not use, install or access Pochipop or any of its features.

 

  This Policy is applicable to information provided by users while using Pochipop, and not to information provided to Pochipop by others.  In the event that Pochipop obtains information about you from websites, applications, landing pages, third parties, etc., that can be accessed by Pochipop users through Pochipop or otherwise, such information will be subject to privacy and other policies and terms of such websites, applications, landing pages, etc.  This Policy will not apply to websites, applications, landing pages, etc.  nor to any third-party services that you access through Pochipop, even if such websites, applications, landing pages, etc.  and / or -Party services are advertised on Pochipop.

 

  You also warrant and represent that any registration information and other information that you submit or provide to Pochipop is true, accurate, and complete, and you agree to keep it that way at all times.

 

  If you are subject to the EU GDPR, you will be asked to give your explicit consent to the Privacy Policy by clicking the "I agree" button.  Rights, in addition to those that apply to you below, are found in Part II of this Privacy Policy.

  Pochipop collects the following information:

 

  1) Information collected with a message:

  To use Pochipop, we may need you to authenticate your account using your Google account, or otherwise, and we will collect your email address and name.  We will also ask you to provide certain information, including age, gender, phone number, your content / category preferences, location, areas of interest, language, region preferences, etc.

  We ask for your location information and regional preferences to personalize your experience by showing you relevant content.  Pochipop can collect and store the current and past location of your device if you allow it.  You have full control over whether or not to allow Pochipop to collect this information by making changes to your device settings.  If Pochipop is unable to access your location information, Pochipop may become inaccessible or may not function as intended.

  Customer Support.  You can also provide us with information related to your use of Pochipop, including copies of your messages / posts, and how to contact you so that we can provide you with customer support.  For example, you can send us an email with information related to the performance of our application or other problems.

  2) Information collected without a notice:

  Device Information: We may collect the following with respect to any device through which Pochipop is used or accessed:

  Device identifiers.

  IP adress.

  OS.

  Operating system version.

  Advertising identifiers.

  Device brand.

  Display functions.

  Network / Wi-Fi provider or other ISP.

  Battery level and usage.

  Memory usage.

  Other applications or services installed or used through the device.

  Type of content and non-personal information related to the ads.

  Profile information.

  Information related to your use of Pochipop, such as content and consumption preferences, interaction with other users, user activity, etc.

  Pochipop can access your device's camera, microphone, photos and / or videos and / or library or audio gallery.

  Pochipop may also collect information provided by third parties that may disclose personal or non-personal information collected by them to Pochipop.  Pochipop has no control or responsibility with respect to third party information practices or information collection methods.

  Pochipop may also collect tracking information, including cookies, DART, beacons, etc.

  Location: Pochipop can collect and store the current and past location of your device if you allow it.  You have full control over whether or not to allow Pochipopi to collect this information by making changes to your device settings.  If Pochipop is unable to access your location information, Pochipop may become inaccessible or may not function as intended.

  Usage and registration information.  We collect information related to service, diagnostics and performance.  This includes information about your activity (for example, how you use Pochipop, how you interact with others who use Pochipop, etc.), log files and diagnostics, crash information, website and performance logs and reports, etc.

  Information we do not collect

  We do not collect any sensitive personal data or information such as password related to other services, financial information such as bank account or credit card or debit card or other details of payment instruments, physical, physiological and mental health condition, sexual orientation, medical records and history or biometric information.

 

  How We Use Information

  We may use all the information we have to help us operate, provide, improve, understand, personalize, support and market Pochipop.

 

  Our Services: We operate and provide Pochipop, including customer support and Pochipop improvement, repair and customization through the use of such information.  We understand how users use Pochipop and we analyze and use the information we have to evaluate and improve Pochipop, research, develop and test new services and features, and perform troubleshooting activities.  We also use your information to respond to you when you contact us.  We may also use your information to (i) display content based on interests, location, offers, etc., (ii) display or provide access to promotions, advertisements, offers, etc., which may be based on your interests and also advertisements.  targeting, ad placement, and ad measurement (iii) displaying location-specific news and weather-related information, (iv) improving search results, content loading, performance, etc.

  With other Pochipop users: your username, profile picture, content you post, send or share.  You can also control how your content is shared with other Pochipop users by adjusting your personal settings.

  With our business partners, affiliates, investors: public information such as your name, username and profile images and any content posted by you (subject to your personal settings).

  We may share information about you with third-party service providers who perform services on our behalf, including to measure and optimize ad performance and serve more relevant ads, including on third-party websites and applications.

  We may share information about you, such as device and usage information, to help us and others prevent fraud.

  We may share information about you for legal, security and safety reasons.

  We may share information about you if we reasonably believe that the disclosure of the information is necessary to: (i) comply with any valid legal process, governmental request or applicable law, rule or regulation, (ii) investigate, remedy or enforce potential violations of this Policy, the Terms and Conditions and the Content Policy.

  To protect the rights, property, or safety of us, our users, or others.

  To detect and resolve any fraud or security problem.

  Security

  We do not assume any responsibility for the security or protection of your information.  However, we take reasonable security measures to protect your information in accordance with industry standards.  This does not guarantee the security of your information, as events beyond our control may also occur.

 

  Assignment, change of control and transfer

  Applicable law and jurisdiction

 

  The validity, construction and enforceability of these Terms and Content Policy, the Privacy Policy will be governed and interpreted in accordance with the laws of the United States.

 

  Either party may refer said dispute for final resolution through arbitration in accordance with the Arbitration and Conciliation Law of 1996. The Court will be made up of three (3) arbitrators.  Each party will appoint 1 (one) arbitrator and the two arbitrators will appoint the third arbitrator.  The arbitration procedure will take place in Bangalore.  The language to be used in the arbitration procedure will be English.

 

  Subject to the foregoing, the United States Courts will have exclusive jurisdiction.

  IOS Users

 

  Collection, use, disclosure, sharing and retention of facial data:

 

  Collection of facial data: information to identify faces and facial expressions.

  Use of facial data: In order for the Pochipop application to work well for its users, we offer tools that apply filters and video effects that adjust to the contours of the user's face, modifying the size and shape of facial features and following the facial movements.

  Facial Data Disclosure: This data is used to create in-app video effects and filters.  The only use of this information is to provide valuable functions for the user.  None of the information collected leaves the user's device.

  Sharing of facial data: We do not share this data with third parties.

  Facial Data Retention: We do not store any facial recognition data.  Also, the information collected by Face Data never leaves the user's device.  However, little data such as user registration data, user recorded videos and user profile photo are stored on our servers.

  TrueDepth API: We use the TrueDepth APIs to create AR ef

 

fects within the application.  The only use of this information is to provide valuable functions for the user.  No information collected by the TrueDepth API leaves the user's device.  We do not share information with third parties, we do not store or otherwise process the data that we access and use through the TrueDepth API.
